The legal issue in the future of the Beta Theta Pi hazing case will be the focus of a special court hearing tomorrow. After the lengthy preliminary hearing wrapped up in September all the felony charges were dismissed by a judge against all 18 fraternity members in the death of Timothy Piazza. Stacy Parks Miller refiled many of the dismissed charges again almost two months later is "When we think a magistrate or district judge makes an error of law, our option is to move the judge aside and have another judge hear it again. That is our so called appeal and we will be electing to do that." President Judge Pamela Ruist is set to hear legal arguments will be heard over where the felony charges will remain or be dismissed once again. The defense attorney argued there was no new evidence in refiling the felony charges, and the original judges decision was correct.
